Agreement
These terms are an agreement between you and Minor Hiccup Limited (“Minor Hiccup”, “we”, “us”), a company registered in New Zealand and the maker of Sync-o’-Lantern (“the app”). By downloading or using the app, or using minorhiccup.com, you agree to them.
If you got the app from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies. If the two disagree, Apple’s agreement wins for App Store users. If you got the app from Google Play, the Google Play Terms of Service also apply to your download and purchase.
How we handle information is described in our Privacy Policy. In short, the app collects none.
Your licence to use the app
We give you a personal, non-exclusive, non-transferable licence to use the app on phones you own or control, as the store you got it from allows. You may use the shows and videos you make for your own Halloween displays, parties and events, including ones the public can see.
You may not:
- copy, resell, rent or redistribute the app;
- reverse engineer it, except where the law allows it;
- get around the purchase check, or remove or hide the free version’s watermark;
- use the app to break the law or anyone else’s rights.
The app, including its software, face designs and artwork, belongs to Minor Hiccup or our licensors. The videos you make are yours, subject to the rights in any music they contain.
Music and other content you use
Sync-o’-Lantern does not come with any music. You choose the songs, lyrics files and backing tracks, and you are responsible for having the right to use them. The one exception is our free demo song. You may use it with the app and share the videos you make with it.
- Playing a song at home for your own household is usually fine. Playing it to the public or posting a video of it online may need permission from the people who own the music.
- Video sites and social networks may mute or remove videos that contain copyrighted music.
- We never see, store or claim any rights to your songs, lyrics or videos.
Free version and full version
The app is free to download. The free version makes short, watermarked previews: live shows and sing-alongs of up to 60 seconds, and videos of up to 45 seconds in 720p.
The full version is a one-time, non-consumable in-app purchase. It removes the time limits and the watermark and adds 1080p video. It is not a subscription. The purchase belongs to the Apple ID or Google account that made it, so it unlocks the app on your other phones and after a reinstall: tap Restore in the app.
Apple and Google take payment and set the price in your local currency. We may change the price or run a sale; a change never affects a purchase you have already made.
Refunds
Because Apple and Google take the payment, they handle refunds under their own policies. We don’t receive your payment details, so we can’t issue refunds ourselves.
- App Store: request a refund at reportaproblem.apple.com.
- Google Play: see Google Play’s refund help.
If something isn’t working, please contact us first. We may be able to fix it.
Setting up your display safely
You are responsible for setting up projectors, cables, speakers and pumpkins safely. Keep electrical equipment dry and suited to where you use it, especially outdoors. Keep cables out of walkways where trick-or-treaters will pass, and keep the volume considerate of your neighbours.
Open-source software
The app includes open-source software. Its vocal separation model comes from Spleeter by Deezer, used under the MIT License. The full licence texts are included with the app. This website uses the Playfair Display and Plus Jakarta Sans fonts under the SIL Open Font License.
Updates and availability
We may update the app to fix problems, add features or meet store rules, and we may stop offering it. We will try to keep the full version working for people who bought it. Some features depend on your phone and its operating system, and may not work on every device.
Disclaimer
We work hard to make Sync-o’-Lantern delightful, but it is provided “as is”. How closely the mouths follow a song depends on the recording, and we can’t promise that the app will work on every phone or with every file, or without interruptions or errors. Where the law gives you rights that can’t be excluded, nothing in these terms takes them away. These include your rights under New Zealand’s Consumer Guarantees Act 1993 and Fair Trading Act 1986, and the consumer laws of other countries, such as the Australian Consumer Law.
Limitation of liability
To the extent the law allows, Minor Hiccup is not liable for indirect or consequential losses, such as lost data or a spoiled Halloween display, arising from your use of the app. Our total liability to you for any claim is limited to the amount you paid for the app in the 12 months before the claim.
Nothing in these terms limits liability that the law does not allow us to limit, including for death or personal injury caused by negligence, or for fraud.
Governing law
These terms are governed by the laws of New Zealand, and the courts of New Zealand can hear any dispute about them. If you use the app as a consumer outside New Zealand, you keep the protections of your own country’s consumer laws, and you can bring a claim in your local courts where those laws allow it.
Changes to these terms
We may update these terms. We will change the effective date at the top when we do. If you keep using the app after a change, the new terms apply.
